Limited Lifetime Warranty

Warranty Coverage and Duration. W. Kirchhoff, Inc. (“Wasserwerk”) hereby extends a lifetime warranty and will either repair or replace, at Wasserwerk's option, any Wasserwerk branded products sold or distributed by it (“Products”) that prove to be defective in material or workmanship, or fail to perform in accordance with Wasserwerk's applicable published specifications in effect as of the date of manufacture as set forth in this warranty. The warranty will be applicable throughout the expected useful service life of the Products [and for as long as the Products and spare parts therefor are being regularly manufactured by Wasserwerk.?] For the avoidance of doubt, use of the term “workmanship” is limited to the construction of the faucet and not its installation. When supplying replacement Products or parts under this warranty, Wasserwerk reserves the right to substitute Products or parts of comparable material, color, value and design for any discontinued designs. Warranty repairs or replacements will not extend the warranty beyond the remaining duration of the limited warranty for the original Products. The warranty will immediately expire with respect to Products that are removed from the location they were originally installed.
Who is covered. This warranty is not transferable and applies only to the original end-user who purchased the Products (“You”), and only to Products that are purchased and installed within the United States and Canada.
Claims Procedure. If you need warranty service please contact and initiate your claim with the builder, contractor or dealer that installed and sold the Products. If that party is unreachable or non-responsive you can contact and initiate your claim with W. Kirchhoff, Inc. at 5125 South Royal Atlanta Drive, Tucker, GA 30084. All warranty claims must be initiated prior to the lapse of the warranty period. Wasserwerk does not assume any responsibility for claims initiated after the lapse of the warranty period. This warranty is conditioned upon your reasonably cooperating with Wasserwerk (and any dealer or other party Wasserwerk designates) in the evaluation of your warranty claim and the implementation of any remedy. Reasonable cooperation includes, without limitation, your providing pictures of the claimed defect upon request. This warranty is further conditioned upon Wasserwerk and its designee having the opportunity to evaluate the Products at the location of its installation. Wasserwerk also reserves the right to decline a claim if you are unable or unwilling to provide proof of purchase, the date of purchase and installation, the name of the builder, contractor or dealer that installed and sold the Products, and a written confirmation that you are the original end-user purchaser of the Products.
Exclusions. Wasserwerk does not assume any responsibility for normal wear and tear of parts, breakage of gaskets or o-rings, water or moisture related damage of any kind, fading or discoloration or other damage due to mold, mildew, chemicals, improper cleaning agents, sunlight or excessive temperatures, hydraulic shock, water pressure surges, hardness, sediments or impurities of water, breakage or causes that result from abuse, misuse, negligence, accident, improper installation, application, or maintenance, or other causes beyond Wasserwerk’s reasonable control. Minor variations or deviations from Products’ specifications, or advertisement shall not be deemed a defect. This warranty will be voided if you modify the Products or use replacement parts that are not approved by the Wasserwerk, you make repairs that are not authorized by Wasserwerk, or you otherwise fail to comply with the guidelines set forth in the owner's manual or Wasserwerk's published instructions. This warranty does not cover any travel or freight expenses, or any removal, reinstallation or other labor costs, including any costs associated with the removal of defective parts or components, and the installation of replacement parts or components. WASSERWERK EXCLUDES AND WILL NOT PAY ANY INCIDENTAL AND CONSEQUENTIAL DAMAGES. By this Wasserwerk means any loss, expense or damage other than to the Products itself that may result from a defect in the Products. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Implied Warranties. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. THE DURATION OF ANY IMPLIED WARRANTIES ARE LIMITED TO THE FIVE YEAR DURATION OF THIS LIMITED WARRANTY; PROVIDED, HOWEVER, THAT NOTHING IN THIS LIMITED WARRANTY SHALL GIVE YOU ANY IMPLIED WARRANTIES YOU WOULD NOT OTHERWISE HAVE, EXTEND THE SAME BEYOND THEIR CUSTOMARY DURATION, OR MAKE WARRANTOR LIABLE FOR ANY IMPLIED WARRANTIES THAT IT WOULD NOT BE LIABLE FOR IF THIS LIMITED WARRANTY HAD NOT BEEN GIVEN.
Affect on State Laws. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from State to State.
